PICKO MOFF LATEST VIDEO UNDER INVESTIGATION FOR POSSIBLY ADVOCATING VIOLENCE; RVIPF WARNS AGAINST INCITEMENT
The Royal Virgin Islands Police Force (RVIPF) has been made aware of a video circulating on social media that appears to advocate for the use of violence as a form of political expression. Detective Chief Inspector (DCI) Kenrick Davis stated that the contents of the video may involve material that crosses the threshold for serious criminal offenses. He emphasized that while everyone has the constitutional right to freedom of expression, it does not permit individuals to express anything without considering the potential consequences for others in society.
DCI Davis referenced Section 351 of the Criminal Code, Revised Edition 2013, which establishes the offense of Intentional Incitement, carrying a maximum penalty of ten (10) years in prison. He also pointed out that Section 19 of the Counterterrorism Act of 2021 addresses actions that intentionally incite others to commit terrorist acts. The Act also defines what constitutes a "terrorist act," and it appears that the statements in the viral video fall within this definition. The penalties under this Act are more severe than those under the Criminal Code, with a maximum penalty of fourteen (14) years in prison and fines of up to $500,000.00 for intentional incitement.
Additionally, DCI Davis noted that Section 14 of the Computer Misuse and Cybercrimes Act provides for criminal charges for material deemed "grossly offensive" or containing a "menacing character."
The RVIPF has initiated an investigation into the video, and the public will be updated as the investigation progresses.
The RVIPF advises the public to refrain from inciting violence in any form and to choose methods of expression that do not endanger the safety and well-being of others.
While the RVIPF have not confirmed exactly which video is under investigation, we believe the video in question is that of public personality Picko Moff, which was released on his social media page on Thursday December 12, 2024. The video went viral within hours, picking up almost 6k views on the page.
Community views were conflicted on its potential to incite harm on sitting House Of Assembly Members.
